These terms of use apply to Ser­vices and Prod­ucts pro­vid­ed by CARSI (ABN 45 397 296 079) (“CARSI” or “we” or “us”).

These terms of use apply to the sale of any Online Course, Face-To-Face Course, and/or any infor­ma­tion and/or products/services that we pro­vide.  Please read these terms of use care­ful­ly before pur­chas­ing and print off a copy for your records..

By pur­chas­ing via our web­site, you accept and agree to the terms of this agree­ment which will bind you.  If you do not agree to these terms and con­di­tions you must cease to con­tin­ue to pur­chase any Ser­vices from us.

Contract and Enrollment

  • The terms of the Edu­ca­tion Facility’s enrol­ment, fees and can­cel­la­tion form these terms and con­di­tions which con­sti­tute a legal­ly bind­ing con­tract (“the Con­tract”) between you (“the Stu­dent”) and CARSI. (“the Edu­ca­tion Facil­i­ty”).

  • Enrol­ment of a Stu­dent on a course is sub­ject to the pay­ment of all out­stand­ing monies owed by the Stu­dent to the Edu­ca­tion Facil­i­ty.

  • In order to enrol in any of the cours­es offered by the Edu­ca­tion Facil­i­ty, the Stu­dent must:

    • be flu­ent in Eng­lish and must meet any Eng­lish pro­fi­cien­cy require­ment spe­cif­ic to the course; and

    • be at least 15 years of age at the begin­ning of the course, unless oth­er­wise spec­i­fied in the course out­line; and

    • pro­vide evi­dence of the suc­cess­ful com­ple­tion of any pre-req­ui­site course where applic­a­ble; and

    • meet any oth­er course spe­cif­ic require­ments.

Fees

  • The Stu­dent will noti­fy the Edu­ca­tion Facil­i­ty imme­di­ate­ly of any cir­cum­stances that may pre­vent the pay­ment of fees on time.
  • The Stu­dent is liable for the cost of any bank or trans­ac­tion charges relat­ed to pay­ment of fees. All cred­it card pay­ments via AMEX will be sub­ject to a trans­ac­tion charge of 1.5% to cov­er bank charges.
  • The Edu­ca­tion Facil­i­ty reserves the right to increase course fees at any time pri­or to the start of the course.
  • The Edu­ca­tion Facil­i­ty will not reim­burse fees in full or part if the Stu­dent:
    • is exclud­ed from the Edu­ca­tion Facil­i­ty for any rea­son; or
    • does not attend the course with­out advis­ing the Edu­ca­tion Facil­i­ty pri­or; or
    • fails to com­plete the course.

Cancellation

  • Any course can­cel­la­tions made by the Stu­dent must be made in writ­ing to the Edu­ca­tion Facil­i­ty at support@carsi.com.au.
  • The fol­low­ing can­cel­la­tion terms apply if the Stu­dent wish­es to with­draw from the course:
    • The Stu­dent pro­vides the Edu­ca­tion Facil­i­ty with notice 6 weeks or more pri­or to the com­mence­ment of a course, the Edu­ca­tion Facil­i­ty will pro­vide a refund of any pay­ments made in excess of any reg­is­tra­tion fee.
    • The Stu­dent pro­vides the Edu­ca­tion Facil­i­ty with notice 21 days or more pri­or to the com­mence­ment of a course, the Edu­ca­tion Facil­i­ty will pro­vide a full cred­it to the Stu­dent.
    • The Stu­dent pro­vides the Edu­ca­tion Facil­i­ty with notice between 20 – 14 days pri­or to the com­mence­ment of a course, the Edu­ca­tion Facil­i­ty will cred­it any pay­ments made in excess of any reg­is­tra­tion fee and retain an admin­is­tra­tion fee totalling 20% of the total course val­ue per stu­dent.
    • The Stu­dent pro­vides the Edu­ca­tion Facil­i­ty with notice 13 – 7 days pri­or to the com­mence­ment of a course, the Edu­ca­tion Facil­i­ty will cred­it 50% of any pay­ments made in excess of any reg­is­tra­tion fee and retain the remain­ing 50% of tuition fee.
  • Where less than 7 days notice pri­or to the com­mence­ment of a course is pro­vid­ed by the Stu­dent, the Edu­ca­tion Facil­i­ty will retain 100% of the tuition fee paid.
    • Where a Stu­dent pro­vides the Edu­ca­tion Facil­i­ty with less than 7 days notice pri­or to the com­mence­ment of a course due to exten­u­at­ing cir­cum­stances, the Edu­ca­tion Facil­i­ty may, at their dis­cre­tion, allow a re enrol­ment if the Stu­dent can pro­vide evi­dence to sup­port their claim of exten­u­at­ing cir­cum­stances with­in 7 days. In these instances, a re enrol­ment fee of $150.00 AUD + GST will be applic­a­ble and payable with­in 7 days of evi­dence being pro­vid­ed. Fail­ure to pro­vide evi­dence with­in 7 days will result in the Stu­dent for­feit­ing 100% of the tuition fee paid
  • With­draw­al from a course, by the Stu­dent, after the com­mence­ment date will result in all fees paid being retained by the Edu­ca­tion Facil­i­ty.
  • Where the Stu­dent is not admit­ted to the course due to tar­di­ness, the Edu­ca­tion Facil­i­ty will retain 100% of the tuition fee paid or offer a 50% cred­it note at its dis­cre­tion.
  • The Edu­ca­tion Facil­i­ty reserves the right to can­cel, post­pone or re-sched­ule any course.
  • In any instances where the course is can­celled, post­poned or re-sched­uled by the Edu­ca­tion Facil­i­ty, the Stu­dent will be pro­vid­ed with a cred­it note for a future course of the same or less­er val­ue, or a full refund if the Edu­ca­tion Facil­i­ty can­not pro­vide the same course to the Stu­dent with­in a 12 month peri­od.
  • All cred­it notes pro­vid­ed by the Edu­ca­tion Facil­i­ty will be held for 12 months from the date of issue.
  • The Stu­dent for­feits their cred­it note if they choose to can­cel a course they have enrolled into util­is­ing a cred­it note, irre­spec­tive of the date of expiry not­ed on the cred­it note.
  • Online cours­es are not eli­gi­ble for a refund.

Deferment

  • Any course defer­rals by the Stu­dent must be made in writ­ing to the Edu­ca­tion Facil­i­ty.
  • All defer­ral appli­ca­tions will be approved on a case by case basis with the infor­ma­tion pro­vid­ed.
  • If approved the Stu­dent may only defer to the next avail­able equiv­a­lent course unless opt­ing to enrol into a course of greater val­ue, in which case the defer­ral may be tak­en any time with­in 6 months with the cred­it amount applied.
  • If the Stu­dent is elect­ing to trans­fer their defer­ral into a course of greater val­ue, the Stu­dent must pay all addi­tion­al course fees 21 days pri­or to the course com­mence­ment date. Fail­ure to do so will result in the Stu­dent for­feit­ing all tuition pay­ments made to the Edu­ca­tion Facil­i­ty.
    • The bal­ance of any course fees out­stand­ing for the course the Stu­dent is defer­ring into must be paid in full 21 days pri­or to the course com­mence­ment date. Fail­ure to do so will result in the for­feit of the course defer­ment cred­it.
  • The fol­low­ing defer­ral terms apply if the Stu­dent wish­es to defer their course:
    • If a defer­ral request is received by the Edu­ca­tion Facil­i­ty between 13 – 7 days pri­or to the course com­mence­ment date the Stu­dent will be cred­it­ed 50% of any pay­ments made less the admin­is­tra­tion fee.
    • If a defer­ral request is received by the Edu­ca­tion Facil­i­ty less than 7 days pri­or to the course com­mence­ment date the Stu­dent will be cred­it­ed 25% of any pay­ments made less the admin­is­tra­tion fee.
    • No defer­ral requests received by the Edu­ca­tion Facil­i­ty less than 24 hours pri­or to the course com­mence­ment date or on the course date will be approved unless evi­dence of exten­u­at­ing cir­cum­stances can be sup­plied by the Stu­dent to the Edu­ca­tion Facil­i­ty.
    • Where the Stu­dent wish­es to defer their course but pro­vides the Edu­ca­tion Facil­i­ty with less than 7 days notice pri­or to the com­mence­ment of a course due to exten­u­at­ing cir­cum­stances, the Edu­ca­tion Facil­i­ty may, at their dis­cre­tion, allow a re enrol­ment if the Stu­dent can pro­vide evi­dence to sup­port their claim of exten­u­at­ing cir­cum­stances with­in 7 days. In these instances, a re enrol­ment fee of $150.00 AUD + GST will be applic­a­ble and payable with­in 7 days of evi­dence being pro­vid­ed. Fail­ure to pro­vide evi­dence with­in 7 days will result in the Stu­dent for­feit­ing 100% of the tuition fee paid.

Courses

  • The Edu­ca­tion Facil­i­ty reserves the right to:
    • Make amend­ments at any time to the syl­labus, edu­ca­tors, tim­ing and any oth­er details of a course as deemed nec­es­sary.
    • allow course edu­ca­tors, at their dis­cre­tion, to refuse admit­tance to any Stu­dent who arrives late to the course in excess of 2 hours from the com­mence­ment of the course time.
    • Record, via pho­tographs, video and/or audio, course learn­ing ses­sions for qual­i­ty assur­ance, edu­ca­tor eval­u­a­tion and mar­ket­ing pur­pos­es. If the Stu­dent does not wish to be par­take in the above record­ed ses­sions please pro­vide a writ­ten state­ment advis­ing the Edu­ca­tion Facil­i­ty.
    • To pro­vide stu­dent con­tact infor­ma­tion onto the sup­pli­ers spon­sor­ing or vis­it­ing the course. Infor­ma­tion that will be passed on will include, Stu­dent Name, Com­pa­ny Name, Email, State and Phone Num­ber as pro­vid­ed on the enrol­ment form. If you do not wish for this infor­ma­tion to be pro­vid­ed to our affil­i­at­ed sup­pli­ers please pro­vide writ­ten notice advis­ing the Edu­ca­tion Facil­i­ty of this.
  • The Stu­dent agrees to the fol­low­ing when con­duct­ing train­ing at the Edu­ca­tion Facil­i­ty:
    • they will arrive to the course 15 min­utes pri­or to the com­mence­ment of the course. Where the Stu­dent is aware they may not arrive on time they are required to noti­fy the Edu­ca­tion Facil­i­ty.
    • they will con­duct them­selves in a pro­fes­sion­al man­ner at all times ensur­ing they are respect­ful of all stu­dents through­out their train­ing at the Edu­ca­tion Facil­i­ty.
  • The Edu­ca­tion Facil­i­ty agrees to the fol­low­ing when pro­vid­ing train­ing to the Stu­dent:
    • pro­vide a safe learn­ing envi­ron­ment for the Stu­dent; and
    • will accom­mo­date late atten­dances when­ev­er prac­ti­ca­ble at the dis­cre­tion of the course edu­ca­tor; and
    • pro­vide the Stu­dent details of any amend­ments to the syl­labus, edu­ca­tors, tim­ing and any oth­er details of a course where these changes will affect their atten­dance.
  • Course Guides will be pro­vid­ed to the Stu­dent at the begin­ning of the course.

Attendance

  • It is manda­to­ry that the Stu­dent attends the sched­uled course they have enrolled in in its entire­ty, this applies to sin­gle day cours­es, sev­er­al day cours­es and night school.
  • Where the Stu­dent does not meet the atten­dance require­ments they under­stand they for­feit all rights to monies paid and are not enti­tled to any make up class­es.
  • The Stu­dent agrees they will arrive to the course 15 min­utes pri­or to the com­mence­ment of the course. Where the Stu­dent is aware they may not arrive on time they are required to noti­fy the Edu­ca­tion Facil­i­ty to avoid pos­si­ble exclu­sion from the course.

Certificates and Awards

  • The Edu­ca­tion Facil­i­ty will pro­vide a cer­tifi­cate to the Stu­dent upon suc­cess­ful­ly pass­ing the required exam­i­na­tion for all applic­a­ble cours­es.
  • The Edu­ca­tion Facil­i­ty will pro­vide any addi­tion­al cer­tifi­cates or will reis­sue a cer­tifi­cate, on applic­a­ble course, at a lat­er date up to 5 years after the ini­tial date of issue, at an addi­tion­al fee payable up front by the Stu­dent.
  • The Edu­ca­tion Facil­i­ty reserves the right not to award a cer­tifi­cate if:
    • the Stu­dent does not reach the min­i­mum pass mark for the course; or
    • the Stu­dent is absent for any rea­son for more than 10% of the course.

Cheating and Plagiarism

  • The Edu­ca­tion Facil­i­ty main­tains a zero tol­er­ance pol­i­cy on cheat­ing and pla­gia­rism. Any stu­dent found to have cheat­ed or pla­gia­rised in any way on their final exam­i­na­tion will be report­ed to the exter­nal asso­ci­a­tion respon­si­ble for that exam­i­na­tion and have any results with­held.
  • The Edu­ca­tion Facil­i­ty will attempt to min­imise the oppor­tu­ni­ties for delib­er­ate or acci­den­tal cheat­ing and/or pla­gia­rism.
  • The Edu­ca­tion Facil­i­ty will ensure all claims of cheat­ing and pla­gia­rism are inves­ti­gat­ed appro­pri­ate­ly and dis­crete­ly, ensur­ing the Stu­dent is respect­ed at all times.
  • All inves­ti­ga­tions into cheat­ing and pla­gia­rism will take into account the lev­el of intent to deceive when deter­min­ing penal­ties.
  • Penal­ties for cheat­ing or pla­gia­ris­ing will vary and may include a warn­ing, a find­ing on their exam­i­na­tion result with­held. Repeat offend­ers may find them­selves exclud­ed from any fur­ther cours­es run by the Edu­ca­tion Facil­i­ty to ensure the integri­ty of all oth­er Stu­dents sit­ting the cours­es.

Behaviour, Health, and Safety

  • To pro­tect the safe­ty and well-being of stu­dents the Edu­ca­tion Facil­i­ty is com­mit­ted to main­tain­ing a drug and alco­hol free envi­ron­ment. The Edu­ca­tion Facil­i­ty pro­hibits the use, dis­tri­b­u­tion, sell­ing or pos­ses­sion of drugs or alco­hol on the Edu­ca­tion Facil­i­ty premis­es.
  • The Edu­ca­tion Facil­i­ty reserves the right to imme­di­ate­ly expel from the premis­es any­one found to be using, dis­trib­ut­ing, sell­ing, in pos­ses­sion of or impaired by drugs or alco­hol.
  • The Stu­dent for­feits all monies paid in an instance where they have been expelled for drug or alco­hol impair­ment.
  • The Stu­dent is expect­ed to behave respect­ful­ly towards staff and oth­er stu­dents at all times. The Stu­dent agrees to ensure their behav­iour does not dis­rupt or encroach on the learn­ing of oth­ers while train­ing at the Edu­ca­tion Facil­i­ty.
  • The Stu­dent is expect­ed to fol­low the instruc­tions of the edu­ca­tor at all times to ensure the safe­ty and enjoy­ment of all oth­ers.
  • The Stu­dent is expect­ed to take per­son­al respon­si­bil­i­ty for their behav­iour and actions and agree to avoid dan­ger­ous behav­iour and encour­age oth­ers to avoid dan­ger­ous behav­iour.
  • The Stu­dent will han­dle all equip­ment pro­vid­ed for use through­out their time train­ing at the Edu­ca­tion Facil­i­ty with care and will do their utmost to ensure they fol­low instruc­tions and pre­vent any dam­age occur­ring.
  • The Stu­dent will ensure their behav­iour does not put them­selves or any oth­ers at risk while train­ing at the Edu­ca­tion Facil­i­ty.
  • The Stu­dent acknowl­edges that if the Edu­ca­tion Facil­i­ty is required to con­tact an ambu­lance for the Stu­dent, all asso­ci­at­ed Ambu­lance costs will be the respon­si­bil­i­ty of the Stu­dent and the Edu­ca­tion Facil­i­ty will not be held liable for any of these asso­ci­at­ed costs.
  • The Stu­dent acknowl­edges that they and/or their Com­pa­ny are pro­hib­it­ed from solic­it­ing any oth­er Stu­dents, the Train­ers or the Edu­ca­tion Facil­i­ty Staff for any recruit­ment for the pur­pose of employ­ment or per­son­al com­mer­cial inter­ests while train­ing at the Edu­ca­tion Facil­i­ty.

Exclusion

  • The Edu­ca­tion Facil­i­ty reserves the right to exclude the Stu­dent either per­ma­nent­ly or tem­porar­i­ly from the Edu­ca­tion Facil­i­ty if:
    • it has rea­son to believe the Stu­dent pos­es a risk to oth­er stu­dents or staff; or
    • the edu­ca­tor deems the Student’s behav­iour to be inap­pro­pri­ate or dis­rup­tive; or
    • the Stu­dent is per­sis­tent­ly in breach of these terms and con­di­tions; or
    • the Stu­dent has mis­led the Edu­ca­tion Facil­i­ty in their enrol­ment process; or
    • the Stu­dent does not meet the course’s spe­cif­ic atten­dance require­ments; or
    • the Stu­dent arrives late to the sched­uled course (exclu­sion will be at the trainer’s dis­cre­tion); or
    • the Stu­dent is found to have cheat­ed or pla­gia­rised in any way on their final exam­i­na­tion; or
    • the Stu­dent has been found to have cheat­ed or pla­gia­rised on mul­ti­ple occa­sions with respect the exam­i­na­tions pro­vid­ed by the Edu­ca­tion Facil­i­ty; or
    • the Stu­dent is found to be impaired by drugs or alco­hol; or
    • the Student’s fees are over­due.
    • the Stu­dent and/or their Com­pa­ny is found to be solic­it­ing any oth­er Stu­dents, the Train­ers or the Edu­ca­tion Facil­i­ty Staff for any recruit­ment for the pur­pose of employ­ment or per­son­al com­mer­cial inter­ests while train­ing at the Edu­ca­tion Facil­i­ty.
    • any stu­dent is dis­cov­ered to be record­ing, via pho­tographs, video and/or audio, online or face to face course learn­ing ses­sions.
  • The Stu­dent agrees that if they are exclud­ed from the Edu­ca­tion Facil­i­ty and/or course for any of the above rea­sons, they for­feit all monies paid for the course they are enrolled into.

Limit to Liability

  • The Edu­ca­tion Facil­i­ty shall not be liable for:
    • the cost of any air­line tick­ets, accom­mo­da­tion charges or any oth­er monies lost by the Stu­dent result­ing from a course can­cel­la­tion, post­pone­ment, re-sched­ule or venue change made by the Edu­ca­tion Facil­i­ty. It is strong­ly rec­om­mend­ed the Stu­dent arrange trav­el insur­ance if they are attend­ing cours­es in a loca­tion where any of the above is required for them to attend the course.
    • any loss of per­son­al prop­er­ty; or
    • the con­se­quences of events beyond its rea­son­able con­trol; or
    • any indi­rect or con­se­quen­tial loss­es or loss of prof­its incurred by the Stu­dent; or
    • the fail­ure by the Stu­dent to gain employ­ment in the work­place upon the com­ple­tion of the course.

Copyright

  • All mate­ri­als pro­vid­ed dur­ing the course, includ­ing but not lim­it­ed to course man­u­als and train­ing meth­ods, are sub­ject to copy­right and are pro­vid­ed by the Edu­ca­tion Facil­i­ty on behalf of our edu­ca­tors and rel­e­vant edu­ca­tion bod­ies, asso­ci­a­tions and cer­ti­fi­ca­tion boards.
  • The Stu­dent will not pro­vide any copy­right­ed mate­ri­als to any oth­er per­son.

General

  • These terms and con­di­tions set out all the con­trac­tu­al terms agreed between you and the Edu­ca­tion Facil­i­ty.
  • No fail­ure or delay by the Edu­ca­tion Facil­i­ty in enforc­ing any of its rights under the Terms and Con­di­tions shall be deemed to be a waiv­er of such right.
  • These terms and con­di­tions are sub­ject to change at any time.
  • All prices quot­ed in these terms and con­di­tions are exclu­sive of GST.
  • Under no cir­cum­stances can stu­dents and/or busi­ness­es record, via pho­tographs, video and/or audio, online or face to face course learn­ing ses­sions. 

Promotions and Special Offers

  • Pro­mo­tion­al fares may be sub­ject to sep­a­rate terms and con­di­tions, where terms and con­di­tions do not line up pro­mo­tion­al fare terms and con­di­tions will pre­vail.
  • Pro­mo­tion­al fares are only avail­able to claim with­in the spec­i­fied times of the pro­mo­tion and are only redeemable on spe­cif­ic cours­es.
  • Pro­mo­tion­al dis­counts can­not be used on any order that has already been placed or in con­junc­tion with any oth­er dis­counts or offers, this includes but is not lim­it­ed to, cred­it notes and vouch­ers.
  • Pro­mo­tion­al fares may require a min­i­mum upfront deposit, deposits paid on pro­mo­tion­al fares are non-refund­able, non-trans­fer­able, not for resale and not redeemable for cash. Pro­mo­tion­al fare deposits will not be cred­it­ed should you can­cel or defer your course enrol­ment.
  • Pro­mo­tion­al fares are avail­able to new and exist­ing cus­tomers across all states and ter­ri­to­ries.
  • The Edu­ca­tion Facil­i­ty reserves the right to with­draw, amend or can­cel a dis­count offer at any time.
